Buying Opened Software

I am in United Kingdom. I have the opportunity to purchase MS Office
2003Pro that was bought along with other items from Dabs Direct for a
business. The other items have been returned to Dabs for a refund, but
because this software has a broken seal, they won't accept for refund. The
box, discs, documentation and licence are as new. What is the legal
position regarding the software licence if I purchase it. Can I do so
without future repercussions?

If the software was never activated there shouldn't be any
problems. If it was, reactivation might require a phone call
and explanation.
