cell bg color vs. date

This formula is giving me an error, I think its because it seems lik
its trying to take the value of the cell and compare it to the date
have in the parenthesis. I dont want the value of the cell to effec
the color in the background. Any help? Couldnt i do something like.

=AND(TODAY()>=DATE(38285),TODAY()<DATE(38287)
