CustomUI and ContextualTabs

Hi Everyone,

Does anyone know how to make contextualTabs visible when they are out of
context ie. TableToolsDesign tab visible when there is no table selected.
Is this possible? I have tried the following to no avail:

<contextualTabs>
<tabSet idMso="TabSetSmartArtTools" visible="true">
<tab idMso="TabSmartArtToolsDesign" visible="true" />
<tab idMso="TabSmartArtToolsFormat" visible="true" />
</tabSet>
</contextualTabs>
