I just checked - they sure are selling the HSE download under Business.

Small & Medium Business > Accessories > Software: Business and
Downloadable > Business and Office > Office Applications

This is so wrong. Microsoft ought to yank their resellers license.

Several times it has been mentioned that Home & Student isn't licensed for
business use. I don't really understand that.
Does that mean that Microsoft will prosectue small business for using it in
their offices?
I friend recommended Home & Office instead of the others because it was more
affordable than the others. She likes it because it has what she needs
without extras she doesn't. She has a small two person business with her
sister. Is it illegal for her to be using it? She & her sister work from
her home.

Its in contravention of the license (Which clearly states 'none commercial
use')

I just read the backof the box the disk came in.
It says "not for use in any commercial, nonprofit, or revenue generating
business activity, or by any government organization".

Wow, I guess that would include having a garage sale and keeping track of
sales in Excel is forbidden, as would doing a bunch of e-bay sales and making
a spread sheet.
I guess small churches would have to use a business one too.

I'm not trying to be snide. It's just that that sentence above practically
forces everyone to use one of the Business disks. "Revenue generating"
covers an awful lot of ground. Why do a Home & Student then? Strange.

I think the MS Licencing scenario is bizarre anyway. You can buy a Retail
version of Office Standard, which has no such limitation under an Academic
Licence - which in UK is VERY much cheaper than the "ordinary" licence - the
only caveat being that you have to qualify for the Academic licence...so if
you are qualified, you can buy an extremely cheap licence and then use it
for commercial purposes....and the Academic version I bought doesn't even
say "Academic" anywhere either on the box or the DVD...

If you qualify through an Academic institution here in the US you can also
get the academic licensing very cheaply in many different versions (Pro,
Ultimate, Standard, etc.) depending on what your academic institution has
"licensed" with Microsoft. The H & S version is for the family that may
have children in school that won't qualify for or need an academic license
or for the family that does not run a home based business but wants to write
letters, presentations etc. that they can send to their friends.
