Licensing - Office 2003 Basic

Unfortunately, I graduated in May and can't purchase the
academic version of Office 2003.

In search of cheap (but legal) version of Office, I
noticed eBay has lots of copies of the OEM Office 2003
Basic version for sale.

They all have this disclaimer "comes with untested
hardware to comply with MS/eBay policies." I was
wondering does this really comply? And is it legit for me
to purchase a copy of Office 2003 Basic version even
though it's not on an OEM machine?

I can't imagine it is. However, I know MS cracks down
pretty hard so why haven't these auctions been taken down?
