I have also found sellers on eBay using the following statement inorder
to sell OEM software.

"In order to comply with eBay's & Microsoft's Software Regulations,
this purchase will include an untested, non-warranted, piece of
hardware at no additional cost to the buyer."

But I looked at Microsofts EULA and they said that the hardware must
include a power source, hardrive, motherboard, case, etc....

How does eBay (or Microsoft) let these sellers get away with selling
under these pretences?

In searching for the best price I found a company offering them as part
of an "Open Vollume License". As I want to be compliant with MS I
asked if I was the legal owner and the vender said no, they were the
legal owner but I get the key to legally use it. It looks like they do
alot of business this way and I was wondering if this is MS compliant.
