As long as you have Windows XP with Service Pack 2 or higher version of Windows then yes, Both Office 2000 and Office XP(2002)
qualify for purchasing an upgrade MS Office 2007 product

I won't need my old software will I? And it upgrades all products in office,
correct?

and how can I check if I have service pack 2? I believe I do since when
checked for updates it was giving me service pack 3 but could not install due
to no longer having my software.....

Press the Windows key + Pause/break key. it states the SP of the
operating system there.

If your old version of Office is already installed and working correctly then you usually won't need the CD available to install an
Office 2007 upgrade, but if at a later date you wanted to install it, you would want the CDs to be able to 'show' the Office 2007
installer that you had a product that qualified you for the upgrade (i.e. an upgrade doesn't increase the number of licenses you
have for Office, the upgrade is a part of the original for licensing).

Depending on the product suite you have in Office 2000 or Office XP(2002) your version of Office may have had additional programs no
longer included in Office 2007, in which case Office upgrades generally only remove products that they can replace, so your 'other'
old versions would remain intact unless you choose a custom installation when starting Office 2007 and telling Office 2007 to remove
the older versions of all Office products.

If you have Microsoft Windows XP you can check the status from
http://windowsupdate.microsoft.com

If you no longer have your Windows software CD, that's one you should get, and if you don't have one of the qualifying products
listed in the
Pricing and Upgrades link on http://office.microsoft.com/suites then your safest path would be to either obtain one of those CDs
before purchasing an Office 2007 upgrade product (for future use, especially if your current installation is 'broken') or purchase a
'Full packaged product' edition of Office that doesn't rely on an older edition of Office being available.
