I have a major dilemma, I have a CD and its getting scratched is there a way
I can take the files from the CD and put it on a brand new non scratched CD?

Yeah, use Nero or some other burning program to copy it.

There are relatively inexpensive devices that will successfully polish
scratched CDs. The thing is that the information is *below* the surface.
I'd copy the disc first if possible just to play safe.

I can concur with that - the paste actually is a very fine abrasive....

Like Alias posted. Copy the CD to another CD with Nero or something similar
