If someone is creating my site do they keep it on their
computer or do I get a disc?

If they publish after they create it, to a my hosting
company of choice, what is the proper ling for this?
they are not hosting but they are what?

If you have paid them, the content is yours as you are the web site owner.

Ok so if they publish and maintain it what is that
called? they are not hosting but do I need to know what
kind of computers servers etc they have firewall? or do I
only worry about what the hosting has?

This may or may not be true depending upon the contracted work. Most web designers keep their copyrighted protections and grant a
license to use the completed site.

The applies to most purchased software today. For example, you do not own FrontPage just because you purchased the package. You
purchased a license to use the software for an indefinite period of time and then only under the specific End User License Agreement
(EULA)

Depends on the agreement you have with them. You'll have to ask them.

They may be creating their site on their pc and publishing it to a server
(host) of your choice. They may be hosting on their server. Or, they may
not be. Once again, you'll have to ask them.

Only they have the answers to your questions.

Don't ask get a contract and read it before you sign it.

I forgot to mention that if the person writing the code writes it for his employer then the employer owns the copyright.

Thanks you guys. I'm just trying to learn the lingo and
know what it is I should be asking and trying to get a
better understaning of how it all works so I don't look
