Using clip art image for personal logo

Can I use an image from Microsoft clip art as part of my personal logo for my
home based retail business?

See the EULA

If you have a valid license to Office, you can use the clips:

Personal items
Business items, under the following restrictions:

1. The clip should not be used as a part of your logo.
2. If you are selling an item which depicts the clip, the clip cannot be
the primary value of the item ( you cannot sell a clipart collection or sell
a book of just clipart, etc)

Local Community Colleges are a great resource for aspiring graphic artist
talent. Or, a local 4-year College may take it on as a class project. Then
you have a custom logo that is unique and full ownership.

OK I read the EUA and it has confused me. Maybe I am missing it, but where
does it say that the clip art image cannot be used in a logo? What about
people who make their own business cards on Publisher? What is the point in
having the clip art there if we are not allowed to use it???

The clipart can be used for just about anything, you can even disassemble it and
change the look if you wish.

Read the EULA from any collection (or any program) you have, the images belong
to the provider, by buying the collection (or program) you have the privilege
of using it.

"Quote" You may not license or distribute any of the Media Elements that include
representations of identifiable individuals, governments, logos, initials,
emblems, trademarks, or entities for any commercial purposes or to express or
imply any endorsement or association with any product, service, entity, or
activity. "End Quote".

I am not a legal person, the advice I gave you was given to Paul and myself
years ago. I assume if you change the clipart so it is not identifiable as
belonging to the Microsoft collection you may get away with using it as part of
your logo. It is your call.

So if I were to copy/paste the image into Word and change it a little bit, I
could use it then??? (I REALLY like the image that I found!) (It's just
balloons with gifts underneath them!)

In the Microsoft Office Word 2003, my licensed version, in the EULA, Sect.
1.5 it clearly states that I can use clipart "media element" if the primary
value of my book is not.... the clipart. I want it in the cover and
miniature size at the beginning of each chapter. The clipart is not the
value of the book, the historical information is the value of the book.

Thanks. I read it and am reading that I can indeed use the clipart as long
as it is not the prmary reaon of the book i am writing.

Please note the last item.

Clip Art
The Microsoft Clip Art Gallery provides a compilation of artwork for your
personal use. Microsoft licenses some of the artwork from third parties and
therefore cannot grant permission for you to redistribute the artwork. For
more information on the terms of use, refer to the End User License
Agreement (EULA) that accompanied the product from which you obtained the
clip art. If you obtained the artwork from Office Online, you can find the
EULA at http://office.microsoft.com/en-us/FX100667421033.aspx.

Many other product EULAs are available at
http://www.microsoft.com/legal/useterms/.

The following guidelines apply to the use of clip art:

1. You may use clip art in your school assignments and projects.

2. You may use clip art in your church brochure.

3. You may use clip art for personal, noncommercial uses.

4. You may not use clip art to advertise your business.

5. You may not use clip art to create a company logo.

6. You may not use clip art to illustrate the chapters of a book.

Since you are apparently writing a book that
will be sold commercially....I'm thinking your
best bet would be to ask your lawyer to look
into the legal uses of MS ClipArt.

And BTW...maybe you missed the following:

# 3. You may use clip art for personal, noncommercial uses.
# 6. You may not use clip art to illustrate the chapters of a book.

Just my opinion but wouldn't it be best if your
book had original artwork on the cover and
as chapter illustrations?

You came here asking for advice and you refuse to accept it.
You can either spend some money on an attorney now or a lot of money later.

I agree with "what's the point of having the clip art..." ... This is
Ridiculous! If we pay somebody to make a logo for us, they're just going to
use some form of clipart! I paid my $200 for this software .. why can't I
USE it ?? MS needs to lighten up on this policy or make it more user
friendly or something. I spent the money on this software, I can't afford a
"professional" logo too! Viscious Circle.

If you pay someone to create a logo for you, I would hope they aren't just
slapping someone else's work together. If you don't agree with the license,
you have the option of returning the software and finding software that
comes with more agreeable terms.

BTW, Microsoft isn't the only place to get clip art.
